How can my boyfriend get divorced here if he got married in Italy and his wife lives there?

I've been living with my boyfriend for almost 3 years, he left his wife in Italy 4 years ago , we have a baby now and want to get married, which are the steps to follow and how much will that cost.

Answer on How can my boyfriend get divorced here if he got married in Italy and his wife lives there?

Divorce is a bit more complicated in Italy than in the U.S. There are a lot of waiting periods and strict rules that apply. Is your boyfriend legally separated (just having left his wife doesn't count, court actions must have been filed)? Then he first has to do that and then wait 3 years before a divorce can be finalized.

While it is possible to get a divorce in another country, it must be registered in Italy for it to be recognized or the Italian state will consider your boyfriend a bigamist if he remarries without doing so.

Your boyfriend should contact a lawyer in Italy or a good international divorce lawyer (the Italian embassy may be able to provide names) for a consulation.
